Terms of Service

By accessing or using Clarity Journal at clarityjournal.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

Clarity Journal is a voice-first AI journaling application. You speak or type your thoughts, and the Service uses artificial intelligence (powered by Anthropic's Claude) to process your entries and return structured insights including themes, action items, mood analysis, and coaching-style reflections.

The Service is provided "as is." AI-generated insights are for informational and reflective purposes only. They do not constitute professional medical, psychological, legal, or financial advice.

To use Clarity Journal, you must create an account via our authentication provider (Clerk). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate information during registration
• Keep your login credentials secure
• Notify us promptly at legal@clarityjournal.ai if you suspect unauthorized access
• Accept responsibility for all activity under your account

Ownership.You retain full ownership of all journal entries, text, and voice recordings you submit to the Service ("User Content"). Clarity Journal does not claim any ownership rights over your content.

License. By submitting User Content, you grant us a limited, non-exclusive license to process, store, and analyze your content solely for the purpose of providing the Service to you. We do not sell, share, or use your journal entries for advertising or training purposes.

AI Processing. Your entries are sent to a third-party AI provider (Anthropic) for processing. This processing is done to provide you with structured insights. We do not use your content to train AI models.

Clarity Journal offers two tiers:

• Free: 5 journal entries per month with AI analysis
• Pro: Unlimited entries with full AI analysis at $7.99/month or $59.99/year

Payments are processed by Polar (with Stripe as the underlying payment processor). By subscribing, you also agree to Polar's Terms of Service.

Subscriptions renew automatically. You can cancel or manage your subscription through the billing page in your account. Refunds are handled on a case-by-case basis; contact us if you believe a charge was made in error.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Submit content that is harmful, threatening, abusive, or harassing toward others
• Attempt to reverse-engineer, exploit, or compromise the Service or its infrastructure
• Use automated tools (bots, scrapers) to access the Service without our written permission
• Interfere with or disrupt the Service for other users
• Impersonate another person or misrepresent your affiliation

By you. You may delete your account at any time. Upon deletion, we will remove your data in accordance with our Privacy Policy.

By us. We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the Service in a manner that threatens its integrity or other users. We will make reasonable efforts to notify you before termination, except in cases of severe abuse.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated insights may be inaccurate, incomplete, or not suitable for your circumstances. You should not rely on them as a substitute for professional advice.

To the maximum extent permitted by applicable law, Clarity Journal and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

We may modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good faith negotiation, and if necessary, binding arbitration.
